PB MOBILE DETAILING SERVICE AGREEMENT

1. Payment Terms

Purpose:

Ensures PB Mobile Detailing is paid promptly, outlines acceptable payment methods, and protects the business’s right to charge late fees and pursue unpaid balances through legal action.

Clause:

The Customer agrees to pay the full service fee immediately upon completion of the detailing service, unless otherwise agreed in writing prior to service. Accepted payment methods include cash, credit or debit card, Square, and other approved digital payment platforms. If full payment is not received by 11:59 PM on the service date, a late fee of twenty percent (20%) of the outstanding balance will apply and accrue every twenty-four (24) hours until the balance is paid in full. PB Mobile Detailing reserves the right to pursue unpaid balances through collections agencies, legal proceedings, or small claims court. The Customer shall be liable for all associated costs, including court fees, attorney fees, and collection expenses.

2. Cancellation & Rescheduling Policy

Purpose:

Encourages timely cancellations, allows PB Mobile Detailing to charge for lost time if customers cancel late, and protects the business from weather or emergency disruptions.

Clause:

The Customer must provide a minimum of twenty-four (24) hours’ notice to cancel or reschedule an appointment. Failure to provide adequate notice or failure to appear for the appointment will result in a late cancellation fee of twenty-five dollars ($25.00) or up to fifty percent (50%) of the scheduled service fee, at PB Mobile Detailing’s discretion. PB Mobile Detailing reserves the right to reschedule or cancel appointments due to inclement weather, emergencies, safety concerns, or circumstances beyond its control. Reasonable notice will be provided when possible.

3. Damage Liability Waiver & Media Release

Purpose:

Limits PB Mobile Detailing’s liability for pre-existing vehicle damage or issues not caused by detailing. Allows the business to take photos for documentation and marketing unless the customer opts out.

Clause:

The Customer acknowledges that PB Mobile Detailing is not liable for any pre-existing damage, wear, or staining, nor for mechanical or electrical malfunctions occurring after service, including but not limited to power locks, alarms, windows, or battery issues. PB Mobile Detailing is not responsible for loss, theft, or damage to personal belongings left inside the vehicle. The Customer agrees to a pre-service inspection, including visual documentation or photographs of the vehicle’s condition. Unless the Customer opts out in writing before service begins, PB Mobile Detailing may photograph or record the vehicle for documentation and promotional purposes, including marketing on social media, websites, and printed materials.

4. Right to Refuse or Terminate Service

Purpose:

Protects PB Mobile Detailing staff from unsafe or hostile situations and allows the business to decline jobs that are beyond its scope or present health or safety risks.

Clause:

PB Mobile Detailing reserves the right to refuse or terminate service if the vehicle is in a hazardous, unsanitary, or excessively poor condition that makes detailing unsafe or impractical, or if the Customer engages in hostile, abusive, or inappropriate conduct. PB Mobile Detailing is not liable for any resulting loss or inconvenience caused by refusal or termination of service.

5. Refund & Satisfaction Guarantee

Purpose:

Clarifies that services are final and non-refundable but still offers a limited window for customers to report dissatisfaction for correction at PB Mobile Detailing’s discretion.

Clause:

All services rendered by PB Mobile Detailing are final and non-refundable. If the Customer is dissatisfied with the service outcome, they must notify PB Mobile Detailing within twenty-four (24) hours of service completion. PB Mobile Detailing may, at its sole discretion, offer a correction, re-cleaning, or other resolution, subject to staff availability and business considerations. Any resolution is optional and not guaranteed.

6. Privacy Policy

Purpose:

Assures customers their personal information is protected and only used for business purposes in compliance with privacy laws.

Clause:

PB Mobile Detailing collects personal information solely for the purposes of service delivery, communication, recordkeeping, and business operations. PB Mobile Detailing will not sell or disclose personal information to third parties except as required by law or with the Customer’s consent.

7. Lien Rights & Legal Recourse

Purpose:

Gives PB Mobile Detailing the right to file a mechanic’s lien on the vehicle for unpaid services and pursue legal action or credit reporting against customers who do not pay. This includes retention of keys until full payment is made after the service is completed. Clause: In the event of non-payment, PB Mobile Detailing reserves the right to file a mechanic’s lien on the Customer’s vehicle as permitted by state law. PB Mobile Detailing may pursue unpaid balances through small claims court, credit reporting agencies, or lawful asset seizure processes. The Customer agrees to reimburse all legal fees, court costs, and collection expenses incurred by PB Mobile Detailing in recovering unpaid amounts.

8. Vehicle Condition & Customer Responsibilities

Purpose:

Clarifies that the Customer is responsible for preparing the vehicle and disclosing any known risks. Protects PB Mobile Detailing from claims over personal items or pre-existing vehicle problems.

Clause:

The Customer is solely responsible for removing all personal items, valuables, and aftermarket accessories from the vehicle prior to service. PB Mobile Detailing will not be held liable for the loss, theft, or damage of any items left inside the vehicle. The Customer must disclose any known issues that could be impacted by the detailing process, including but not limited to loose components, sensitive surfaces, or prior damage. PB Mobile Detailing is not liable for battery discharge, malfunctioning locks, alarm system activations, or similar mechanical or electrical failures occurring as a result of normal detailing procedures.

9. Force Majeure

Purpose:

Protects PB Mobile Detailing from legal responsibility if events beyond its control prevent the business from performing the service.

Clause:

PB Mobile Detailing shall not be liable for failure or delay in the performance of its obligations under this Agreement if such failure is caused by circumstances beyond its reasonable control. These include, but are not limited to, natural disasters, extreme weather, acts of God, power outages, labor disputes, pandemics, governmental orders, or supply shortages. PB Mobile Detailing reserves the right to cancel or reschedule services in such events without liability.

10. Indemnification

Purpose:

Protects PB Mobile Detailing from lawsuits or claims caused by the Customer’s negligence, actions, or pre-existing vehicle conditions.

Clause:

The Customer agrees to indemnify, defend, and hold harmless PB Mobile Detailing, its owners, employees, and affiliates from any claims, damages, losses, or legal actions arising from:

● The Customer’s breach of this Agreement;

● Pre-existing conditions of the vehicle;

● The Customer’s negligence or misconduct.

This indemnification obligation shall survive completion of the services.

11. Service Limitations & Expectations

Purpose:

Manages the Customer’s expectations by clarifying that some cosmetic or mechanical issues may be permanent and cannot be fully remedied by detailing.

Clause:

PB Mobile Detailing makes no guarantee of complete stain, odor, or imperfection removal, as some damages may be permanent. PB Mobile Detailing’s services are intended to restore and enhance, but not necessarily return, a vehicle to factory-new condition. Older vehicles or those with heavy wear may have surface vulnerabilities that limit detailing results despite best efforts.

12. Pricing & Estimates

Purpose:

Allows PB Mobile Detailing to adjust pricing when the actual vehicle condition requires more labor, time, or materials than originally quoted.

Clause:

All price quotes provided by PB Mobile Detailing are estimates based on the Customer’s description of the vehicle’s condition. PB Mobile Detailing reserves the right to adjust final pricing after in-person inspection if the actual vehicle condition differs materially from the Customer’s description. PB Mobile Detailing will notify the Customer of any price adjustments before services begin. Final pricing is based on the time, labor, and materials required to complete the job.

13. Environmental Responsibility & Water Usage

Purpose:

Ensures PB Mobile Detailing complies with local, state, and federal environmental protection laws and reserves the right to refuse service in non-compliant locations.

Clause:

PB Mobile Detailing complies with all applicable federal, state, and local environmental regulations regarding water usage and chemical runoff. The Customer is responsible for ensuring the service location is compliant with these regulations and that it allows for the lawful performance of detailing services. PB Mobile Detailing reserves the right to refuse or discontinue service if the worksite presents an environmental hazard or violates applicable regulations.

14. Entire Agreement

Purpose:

Clarifies that this written document is the full and binding agreement between the parties, replacing any prior conversations.

Clause:

This Agreement constitutes the entire understanding between PB Mobile Detailing and the Customer and supersedes all prior discussions, communications, or agreements, whether written or verbal. No amendment or modification of this Agreement shall be valid unless in writing and signed by both parties. This Agreement shall be governed by the laws of the State of Utah.
